We may disclose Personal Information when required by law or regulation or in the good faith belief that such action is necessary in order to conform to the edicts of the law, comply with legal mandates, or to protect the rights, property, or personal safety of Kenexa, its employees, users and the public.
We may use personal information we obtain relating to you, including but not limited to your name, mailing address, phone number and email address, for the purposes of contacting you, conducting internal business research, and carrying out other marketing activities.
In order to download documents on this Web site or apply for a job, you must first complete the registration form and/or create a user name and password. During registration you are required to give contact information (such as name, phone number and email address). This information can be used to contact you about our services or a job posting.
We may collect prospective employee information through use of our own application for internal job placement. That information will be treated according to local regulations governing employment practices.
Marketing and other activities
When registering on the website, you have the option of receiving different subscriptions. These options include Press Releases, Kenexa Connections (bi-monthly newsletter), or EvolveHR (Kenexa’s Magazine). In order to receive EvolveHR, your physical address will be required.
From time to time we send our visitors and/or clients e-mail messages with new site feature announcements, enhancements, maintenance information and general updates. We provide you the opportunity to ‘opt-out’ of having your personally identifiable information used for certain purposes, when we ask for this information. We communicate with users on a regular basis to provide requested services and in response to issues relating to your account via email or phone.
From time to time we collect and store information generated through use of our on-line business services. We may use some of this information in the aggregate for marketing research, such as, for example, in compiling statistics on Kenexa's website visitors and in assessing clients' business needs. If we decide to mention a particular client on the site, we will take reasonable steps to gain that client's consent before posting.
We may collect and store information provided directly or indirectly to us through participation in online contests and/or client satisfaction surveys and the like.
We may create standard usage logs through our web server, such as IP address, browser type, and access times.
We use our web server to recognize your domain name and track your use of the website.

Clear Gifs (Web Beacons/Web Bugs)
Our third party advertising partner employs a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that helps us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our customers’ personally identifiable information. If you purchase services from us, we request certain personally identifiable information from you on our order form. You must provide contact information (such as name, email, and address) and financial information (such as credit card number, expiration date).
We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you. This information is also used to send you updates on the product or service you purchased.
Some Kenexa events will require you to pay to attend. Kenexa uses third parties to process the credit card transactions. The billing information is not stored on Kenexa’s servers.
We use third parties (i.e., emailing or direct mail services, marketing services, Web analytics) to assist with the marketing services on our site. When you register on the website or purchase services from us on-line, we will share your name and address as necessary for the third party to provide service. These third parties are not permitted to use such information for their own purposes.
Kenexa does not share, sell, trade, or rent your personal information to third parties for their promotional purposes.
If you choose to use our referral service to tell a friend about our Kenexa Connection newsletter, we will ask you for that person’s name and email address. We will automatically send that person a one-time email inviting him or her to visit the site. Kenexa does not store this information. Your friend may contact us at Privacy@kenexa.com to request that we remove this information from our database.
Maintenance of Data and Passwords
For our web systems on which you have a user account, you have access to your information to update and maintain your profile. It is solely your responsibility to maintain the confidentiality of your password. If you believe your password has been compromised, please contact Privacy@Kenexa.com.
If your personally identifiable information changes, or if you no longer desire to receive marketing materials, you may correct, update, delete or deactivate it by emailing Privacy@kenexa.com. Kenexa will respond to your request within 30 days of receiving the request. If your personally identifiable information changes, or if you no longer desire our service, you may update this information by making the change on our member information page or emailing us at Privacy@Kenexa.com. To access your information you must login by clicking on “Log in” in the upper right hand corner. If you don’t remember your password, it can be emailed to you by using the “forgot password” function. Once logged on, click “My Account” in the upper right hand corner. This page will allow you to make changes to your contact information, update subscriptions and change your password.
We may provide access via a hyperlink in an email or a web page or through on-line support when you need to update or correct your contact information or, for clients, to report a bug or problem with their system.
We will retain your information for as long as your account is active or as needed to provide you services and comply with our legal obligations, resolve disputes, and enforce our agreements.
We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. When you enter sensitive information (such as a credit card number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL). No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

Cookies and Google Analytics
We use both session ID cookies and/or persistent cookies. We use session cookies to make it easier for you to download documents on the site. A session ID cookie expires when you close your browser. A persistent cookie remains on your hard drive for an extended period of time. You can remove persistent cookies by following directions provided in your Internet browser’s “help” file.
If you chose to do so, we set a persistent cookie to store your passwords, so you don’t have to enter it more than once. Persistent cookies also enable us to track and target the interests of our users to enhance the experience on our site.

The Kenexa websites use Google Analytics, a web analysis service of Google Inc. Changes to this Policy
Kenexa provides our customers with applications that facilitate many Human Resource related requirements. These applications are not a part of our corporate web site. Kenexa serves as a Data Processor for the clients who use these applications. More specifically, Kenexa does not own the information that is submitted to our applications. The information that is submitted to our applications will be subject to our clients’ privacy policies.

The following information discloses how information is submitted via our applications and how we handle the information for our clients who are the owners of this data.
Notice/Use of Personal Information
Because it supplies a hosted system, Kenexa operates as a data processor for its customers. Kenexa’s customers act as data controllers. Individual users involved in employment activities may interact directly with Kenexa's customers rather than with Kenexa. Kenexa provides its customers with the option of disclosing their relationship with Kenexa by providing notice to individual employees and candidates of the customer regarding the Kenexa technology that they use. Kenexa maintains only that Personal Information which its customers have asked Kenexa to process. It is the Kenexa customer's responsibility to ensure that the data the customer collects can be legally collected in the country of origin. The Kenexa customer is responsible for giving its employees, applicants and users the appropriate level of notification that Personal Information is being collected and maintained.
Notification of Changes/Choice
We are a global corporation with operations in several countries. We have developed global data practices designed to assure Personal Information is appropriately protected. While our primary data centers are in the USA, we may transfer Personal Information to Kenexa offices outside of the United States. In addition, we may employ other companies and individuals to perform functions on our behalf. If we disclose Personal Information to a third party or to Kenexa employees outside of the United States, we will ensure that such party has agreed to abide by the Safe Harbor principles or is subject to the Data Directive, or can otherwise assure adequate protection of such Personal Information.
Kenexa will use Personal Information only in ways compatible with the purpose for which it was collected or authorized by our customers.
Kenexa is committed to ensuring the security of the Personal Information that it processes. To prevent unauthorized access or disclosure, maintain data accuracy, and ensure the appropriate use of Personal Information, Kenexa has adopted appropriate physical, electronic, and managerial procedures to safeguard and secure the Personal Information we process. Kenexa strives to protect the privacy of the Personal Information it processes, and inadvertent disclosure is unlikely. In the event of such an inadvertent disclosure, Kenexa will take all commercially reasonable steps to limit and remedy the disclosure. However, Kenexa cannot guarantee that unauthorized third parties will never be able to defeat those procedures or use Personal Information for improper purposes.
In most cases, when Kenexa collects Personal Information, it does so on behalf of another company (as an agent or data processor). To request access to, correction, amendment or deletion of this Personal Information, a user should contact the company to which the data was provided.

Cookies and Links to Other Sites
You may have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline all cookies if you prefer. Alternatively, you may be able to modify your browser setting to notify you each time a cookie is tendered and permit you to accept or decline cookies on an individual basis. If you choose to decline cookies, however, that may hinder performance and negatively impact the use of the hosted software.
Our hosted software may contain links to other sites. Please be aware that we are not responsible for the privacy practices or content of such other sites.
Kenexa is committed to protecting the privacy needs of children and we encourage parents and guardians to take an active role in their children's online activities and interests. Kenexa does not knowingly collect information from children under the age of 13 and Kenexa does not target its website or its products to children under the age of 13.
